A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. 피고인은 2016. 5. 28. 20:53경 대구 남구 B에 있는 ‘C’ 식당에서 불상의 남성과 합석하여 술을 마시면서 불상의 남성에게 ‘형님’이라고 호칭하며 대화를 하다가 옆 테이블에서 술을 마시던 피고인이 임차하여 살고 있는 집주인인 피해자 D(65세)로부터 ‘아버지뻘 되는 사람한테 형님이라고 하지 마라’는 말을 듣게 되자 피해자의 멱살을 잡고 실랑이를 하던 중 화가 풀리지 않자 대구 달서구 E에 있는 피고인의 주거지로 가 위험한 물건인 식칼(전체길이 29cm, 칼날길이 18cm)을 가지고 위 식당으로 다시 돌아가 피해자에게 식칼을 보여주며 ‘오늘 한번 해보자’라고 말하는 등 피해자에게 위해를 가할 듯이 피해자를 협박하였다.
