A shall be punished by imprisonment with prison labor for eight months and by imprisonment for six months.

Punishment of the crime

1. No game products related business entity of defendant A shall allow any gambling or other speculative act using game products, and no one shall provide game products for use, the rating of which is not obtained from the Game Rating Board;

Nevertheless, from May 11, 2012 to June 16, 2012, the Defendant established 40 PC game equipment “sea-to-sea” on the first floor of Heungdong-gu E, Hoju-si, which was not rated by the Game Rating Board, and took advantage of the network by employing F, G, B, and H as an employee, and given points by receiving money from the customers who found the place, and then let the customers conduct the “sea-to-sea-to-sea game” in betting one hundred points at one time, and exchange the remaining points after the completion of the game directly with cash after deducting 10% as money exchange commission.

The Defendant had game products perform speculative acts using the above method, and provided game products for use which were not rated by the Game Rating Board.

2. From May 12, 2012 to the 13th day of the same month, Defendant B: (a) given points in return for money from customers who found there; (b) granted customers who are game products related business entities A, and (c) allowed customers to carry out the “sea-to-sea game” in betting once more than 100 points; and (d) allowed them to carry out speculative acts using game products in cash by deducting 10% of the remaining points after the completion of the game from money exchange commission; and (e) aiding and abetting them by taking advantage of the game products in return for the use of the game products not rated by the Game Rating Board.
