A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 피고인과 B의 공동범행 피고인과 B는 2014. 4. 26. 05:10경, 아산시 C에 있는 D 운영의 E 편의점 앞 테이블에서, 직장동료인 F과 술을 마시다가 B와 F이 시비되어 다투며 편의점 유리창을 깨뜨리는 등 소란을 피우던 중, 위 편의점 종업원의 112신고를 받고 출동한 아산경찰서 G파출소 소속 경사인 피해자 H(43세) 및 같은 파출소 소속 경사인 피해자 I(42세)으로부터 사건경위, 인적사항 확인 등을 요구받자, B는 피해자 H에게 “야 이 씨발놈아, 죽어볼래”라고 욕설하며 손으로 피해자의 가슴부위를 2회 가량 밀치고, 양손으로 피해자의 멱살을 잡아 흔들고, 이에 피해자 I이 진술거부권, 변호인선임권 등을 고지하며 B를 공무집행방해 혐의로 현행범인체포하려 하자, 옆에 있던 피고인은 양팔로 피해자 I의 몸을 감싸 안고 수회 끌어당기며 체포를 저지하고, 피해자 H이 B에게 수갑을 채우려 하자 “야 이 짭새 새끼들아”라고 수회 욕설하면서 피해자 H의 손을 잡아끄는 등 폭행하였다.

Accordingly, in collusion with B, the Defendant interfered with the handling of the 112 reported case by police officers and the lawful execution of duties concerning the arrest of flagrant offenders.

2. The defendant's sole criminal conduct;

A. The Defendant committed an act of obstruction of performance of official duties, such as the date, time, place, and the description in paragraph (1) of the same Article, the Defendant, who was engaged in the act of obstruction of performance of official duties, followed by the victim J (17 years of age) one time in front and rearel, and assaulted the victim by walking three times his/her right right mouth.

B. The Defendant who destroyed property was engaged in obstruction of the performance of official duties, such as the date, time, place, and the description in paragraph (1), and damaged the victim’s plastic chairs by being laid on the floor at a convenience store of about 40,000 won in the market price owned by the victim D.

C. (1) The Defendant shall make intimidation at the time and place specified in paragraph (1).
