A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 업무 방해 피고인은 2017. 6. 11. 09:55 경 경기도 고양시 덕양구 B에 있는 피해자 C( 여, 49세) 이 관리하는 'D' 음식점에서, 술에 취하여 아무런 이유 없이 식사 중인 손님들에게 " 씨 발년, 좃 같은 년" 이라고 큰소리로 욕설을 하고, 자신이 담배를 피우는 것을 피해 자로부터 제지 당했다는 이유로 “ 씨 팔 년, 재수 없는 년” 이라고 큰소리로 욕설을 하는 등 소란을 피움으로써 위력으로 피해자의 음식점 영업 업무를 약 15분 동안 방해하였다.

2. Definating;

가. 피해자 E에 대한 모욕 피고인은 제 1 항 기재 일시장소에서 음식점 종업원 2 인 및 손님 여러 명이 있는 가운데 술에 취하여 아무런 이유 없이 그곳에서 식사를 하고 있던 피해자 E( 여, 42세 )에게 “ 씨 발년, 좃 같은 년” 이라고 큰소리로 말하여 공연히 피해자를 모욕하였다.

나. 피해자 F에 대한 모욕 피고인은 제 1 항 기재와 같은 날 10:10 경 위 음식점에서 음식점 종업원 2 인 및 손님 여러 명이 있는 가운데, “ 술에 취한 사람이 음식점에서 행패를 부리고 있다” 라는 112 신고를 받고 출동한 경기 고양 경찰서 소속 경사 피해자 F( 남, 36세 )으로부터 귀가를 권유 받자 피해자에게 " 이 좃 같은 새끼가 지랄 하네, 이 병신은 뭐야 "라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
