A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. Crimes against the resident registration certificates B;
A. At around 11:00 on June 10, 2013, the Defendant: (a) obtained one resident registration certificate lost by the victim B at the same Dong-dong Office, Daegu-gu, Daegu-dong; (b) did not take necessary procedures such as returning it to the victim; and (c) embezzled the lost things of the victim.
B. Around 10:30 on June 12, 2013, the Defendant violated the Resident Registration Act, while opening a new mobile communication in the “E” of the operation of D in Daegu Dong-gu, Daegu-gu, the Defendant unlawfully used another person’s resident registration certificate by presenting the completion of the resident registration certificate under the name of the head of the Daegu Metropolitan City Dong-gu, Daegu-gu, as stated in paragraph 1(a) as the Defendant.
C. At around 10:30 on June 12, 2013, the Defendant forged private documents, using a black tool on the paper of “B”, “B”, “F”, and “B” to the name column, “F”, and “B” to the customer column. In addition, the Defendant signed on the paper of “B” in the name column, “B”, “F” in the resident registration number column, “F”, and “B” in the customer column, and signed on the paper of “B” by using a stamper on the printed form of “B”, “B” in the name column, “F” in the resident registration number column, and “B” in the customer column.
Accordingly, for the purpose of uttering, the Defendant forged the “new service contract” under the name of private document B, which is a private document on rights and obligations and one copy of the “contract for the installment transaction of a device.”
At around 10:30 on June 12, 2013, the Defendant issued a forged “service contract” and a “contract for the installment sale of a device” and a “contract for the installment sale of a device” to D, who is aware of the forgery, as prescribed in paragraph 1(c), as if they were the document duly formed.
