A defendant shall be punished by imprisonment for seven years.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Criminal facts

The defendant is the father of the victim C (V).

1. Violation of the Act on the Punishment of Sexual Crimes and Protection of Victims Thereof (Minor Rape, etc. under thirteen years of age);

A. On February 2, 2009, the Defendant: (a) at the Defendant’s house located in Ycheon-si, the mother of the victim (at that time 12 years of age) was traveling to the Defendant’s house and tried to open a knife the victim’s house “to open a visit ......”; (b) tried to open a knife and knife the victim’s face by opening the door into the main room; (c) opened the knife; (d) opened the knife; and (e) opened the victim’s knife, pushed the victim’s shoulder on his hand; and (e) had sexual intercourse with the victim by failing to resist the victim’s face when putting the victim’s head on the knife and knife the victim’s face.

Accordingly, the defendant committed an indecent act against the victim under 13 years of age.
