A defendant shall be punished by imprisonment for seven years.

The defendant shall be ordered to complete the sexual assault treatment program for 80 hours.

Punishment of the crime

The defendant is a father of the victim F, who is a relative with the victim.

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (a minor under thirteen years of age), and quasi-rape in the relation of relatives in violation of the Act on Special Cases concerning the Punishment

A. A. As a result, the defendant raped the victim under 13 years of age who is in a state of impossibility to resist.

In the same manner, the victim F (at the time 12 years of age) was frightened with the victim's chest by her hand by raising the victim's 12 years of age, exceeded the victim's will and clothes, and her fingers were collected into the victim's sound book several times, and the Defendant's sexual organ was inserted into the victim's sound book and had sexual intercourse with the victim.

As a result, the defendant raped the victim under 13 years of age who is in a state of impossibility to resist.

C. On July 2013, the Defendant: (a) laid down the victim F (the 12 years of age at that time) from the victim F (the 12 years of age at that time) who was divingd in the Defendant’s leakage or residence in Seo-gu Busan Metropolitan City, Seo-gu, Busan; (b) laid off the victim’s chest, exceeded the victim’s will and clothes; and (c) repeated the Defendant’s finger by inserting the Defendant’s finger into the victim’s sound book several times; and (d) sexual intercourse by inserting the Defendant’s sexual organ into the victim’s sound book.

As a result, the defendant raped the victim under 13 years of age who is in a state of impossibility to resist.

2. Quasi-rape in relation to relatives in violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes;
