A defendant shall be punished by imprisonment for nine years.

The defendant shall be ordered to complete a sexual assault treatment program for 100 hours.

Punishment of the crime

The defendant is the victim E, the mother of the victim D, and the person who is related to the victim D by reporting marriage on August 18, 2008.

나. 피고인은 2010. 6.경 20:00경 위 주거지 내 피해자 D(여, 11세)의 방안에서 위 E이 직장에서 야근을 하느라 집을 비운 틈을 타 피해자를 강간할 것을 마음먹고, 강제로 피해자의 바지와 팬티를 벗겨 반항을 억압한 다음 손으로 피해자의 음부를 만지고, 가슴을 핥고 주무르며 피해자의 양 볼을 눌러 입을 벌리고 혀를 집어넣고, 계속해서 피고인의 옷을 벗고 1회 간음하였다.

Accordingly, the defendant raped the victim under 13 years of age.

C.
