A defendant shall be punished by imprisonment for five years.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

On July 15, 2014, the Defendant, as the guide of the victim C’s mother, married with D on July 15, 2014, formed a pro-friendly relationship with the victim’s mother, such as the Plaintiff’s leaving her mother, etc., and, upon demand of the victim C to engage in sexual intercourse, was aware that the victim would not easily indicate or resist the refusal.

1. Violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (a indecent act committed by a minor under the age of 13) committed an indecent act by hand by taking advantage of the fact that the victim was locked by himself/herself and was able to resist with the victim (the age of 12 at that time) at the home of the defendant in the Yejin-gu, Jinjin-gu, Jeonjin-gu, Seoul at night on the same time, and that the victim was locked.

2. Control and rape of a minor;

3. The Defendant violated the Act on the Protection of Children and Juveniles against Sexual Abuse (e.g., deceptive scheme) demanded the victim to have a defect in the sexual intercourse on or around June 1, 2016, but the victim expressed his/her intention to refuse the request. However, the victim’s intention to refuse the request is based on the omission of the victim and his/her family members.
