A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime

1. On August 26, 2014, the Defendant: (a) at the Defendant’s house in Jincheon-gun, Jincheon-gun; (b) without having cultural products rights; and (c) without having intent or ability to sell cultural products rights, the Defendant prepared and posted a notice to sell KRW 100,000 upon accessing the Internet NAVER website by means of a computer; (c) sent text messages to the victim G with contact; and (d) pretended to sell KRW 100,000 to KRW 80,00,000 as if he/she were to sell KRW 10,000,000,000 to KRW 80,000; and (c) received money from the Defendant’s agricultural bank account around August 26, 2014 from the victim.
2. On August 26, 2014, the Defendant: (a) at the home of the above Defendant; (b) did not have a performance pocket book; and (c) did not have an intent or ability to sell performance pocket book; (d) prepared and posted a notice to sell “H contact pocket book” by accessing an Internet Nurier’s website by using a computer; (c) posted the image of the performance pocket book created by the Defendant at will; (d) sent and received text messages with the victim I who reported and contacted; and (e) sent KRW 270,00 from the Defendant’s agricultural bank account around August 26, 2014, deeming that he/she would sell the performance pocket book in KRW 270,000,000 as if he/she were the victim’s agricultural bank account.

3. On November 3, 2014, the Defendant: (a) at the Defendant’s home in Jincheon-gun, Jincheon-gun 303, the Defendant did not intend or have the ability to pay the purchase price of cultural products; and (b) under the absence of an intent or ability to pay the purchase price of cultural products, the Defendant contacted the victim Jin-J that prepared a letter to sell cultural products tickets on the Internet NAVV Roster; (c) would want to purchase cultural products; (d) first, if he is informed of the ID and password of the local wifeland, he would use a merchandise coupon and pay 50,000 won in cash by sending text messages from the victim.
