A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On December 22, 2016, the Defendant was sentenced to imprisonment with prison labor for night buildings, larceny, etc. at the Busan District Court on September 26, 2017 and completed the execution of the sentence at the Busan Detention House on September 26, 2017.

1. On October 29, 2017, the Defendant: (a) committed intrusion on a one’s own structure and theft; (b) discovered that, around October 29, 2017, the Defendant: (c) opened a corrective device at the place where the business was completed and opened the place where the business was prepared for the purpose of stealing cash by entering the said place; and (d) one finger, etc. and one Rabber, which had been prepared in advance for the purpose of stealing cash by entering the said building, entered the place where the crime was committed; and (c) discovered that the security key of the “E” main points of the victim’s D operation on the third floor of the said C building, located in the front fire hydrant of the said main point.

The Defendant released the above security key from the above main point of view by using it, and entered the above main point of view, and then removed 200,000 won in cash within the payment period for cash withdrawal in which the keys was opened at the scene of the said main point of view, and cited 1,20,000 won in cash owned by the victim, such as taking out 1,00,000 won in cash deposited below the payment period for cash withdrawal.

Accordingly, the defendant invadedd on a structure managed by the victim, and stolen the victim's property.

2. On November 4, 2017, at night, the Defendant: (a) committed larceny against structures at night; (b) around November 17:35, 2017, at around the main point of “E” in the operation of Victim D; and (c) used the aforementioned security key in front of the aforementioned main point to remove the corrective device of the said main point; and (d) entered the said main point; and (c) took the key into the said main point, and (d) took cash transfer, the Defendant 26,400 won in cash within the payment period in which the key was stuck.

Accordingly, the defendant stolen the victim's property by intrusion on the structure managed by the damaged person at night.
