Reasons
1. Basic facts
A. The Plaintiff is a cargo insurer with respect to Methan (Methan) 2,399.742 tons (hereinafter “instant cargo”) transported at sea by a corporation running insurance business, etc. The Plaintiff’s Intervenor was a corporation operating the storage business of hazardous substances, etc., and the Plaintiff’s Intervenor stored the instant cargo in the land tank (T303) in the terminal before loading. The Defendant is the owner of the instant ship who transported the instant cargo as a corporation operating the maritime transportation business.
B. After entering into a contract to sell the instant cargo to ELVmmmmmm Co., Ltd. (hereinafter “ELmmm Co., Ltd.”), ELV Co., Ltd. concluded a maritime cargo insurance contract with the Plaintiff with an amount of insurance coverage of KRW 1,214,400,000, in order to receive compensation for losses caused by accidents occurring during the course of shipping the instant cargo to ELmmmmmmmmmmmms from the instant vessel and transporting

On April 1, 2013, the instant vessel arrived at Pyeongtaek Port, around 20:0, and went through a tank inspection at around 15:00 on April 2, 2013, at around 13:40, and around 15:00 on April 2, 2013, the instant vessel arrived at the wharf, followed by a tank inspection at around 1: central tank (1-C), 2 unit, and 3 unit tank, 3 unit, 4 unit tank, 4 unit tank, 5 unit tank, 5 unit tank, and 5 unit tank: 2,39.742 tons of the instant cargo, and entered the wharf at around 21:50 on April 3, 2013, at around 205:5:40 on the same day, the instant vessel arrived at the wharf at around 20:50 on April 30, 2013.

However, the loading and unloading of the instant cargo was suspended as the Ethylene DNA DNAide (hereinafter “EDC”) was detected in the instant cargo while loading and unloading the instant cargo at around 14:50 on the same day.
