A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
No one shall supply, sell, store, transport, or keep petroleum products, petrochemicals, alternative fuel, materials containing carbon and hydrogen in order to use them in manufacturing fake petroleum products or using them as fake petroleum products, and shall manufacture, import, store, transport, keep, or sell fake petroleum products.
From December 1, 2012, the Defendant leased an underground storage tank (D gas station) side of the “D gas station” located in Dongducheon-si, from the operator of the said gas station, and intended to trade a hazardous substance storage tank with the trade name “E”, with the tank 2, 2, Toluenent tank 1, 1, Mean-gu tank 1, B, and C oil tank 1, and the change of the dangerous substance storage tank.
Around 02:00 on January 3, 2013, the Defendant purchased 20,000 litres from Medler F, who was charged with restraint and convicted on July 16, 2013, and stored them in a storage tank delivered from G, which is a tank work (retained and convicted on August 23, 2013), and sold them to the needy persons around that time.
Around January 25, 2013 through F and G in the same manner, the Defendant purchased 32,000 liters for regeneration around January 30, 2013, and sold 32,00 liters for regeneration around January 30, 2013, and 32,00 liters for regeneration around February 16, 2013, and around February 16, 2013.
As a result, the Defendant stored and sold approximately 20,000 liter of mertans, which is a petrochemicals, and approximately 96,000 liter of renewable solvents, which is a petroleum product, in order to make it manufactured and used as fake petroleum products.
