All appeals by the defendant and the prosecutor are dismissed.

1. Summary of grounds for appeal;

A. Defendant 1) In the event that misunderstanding of the facts or misunderstanding of the legal principles makes a moving to the Korean press center building or to the Seoul square, police officers did not attempt to execute a warrant of arrest against I, and the Defendant also did not interfere with the execution of a warrant of arrest as well as the moving with I.

Nevertheless, the defendant's movement as above and interfered with the execution of special duties and the criminal's escape from such movement.

In the original judgment, there is an error of misunderstanding of facts or misunderstanding of legal principles.

2) The punishment sentenced by the lower court (one year of imprisonment, two years of suspended execution, and observation of protection) is too unreasonable.

B. The sentence imposed by the prosecutor by the court below is too uneasible.

2. In relation to the defendant's allegation of misunderstanding the facts or misapprehension of the legal principles, violence means not only the exercise of direct tangible power against public officials, but also the exercise of indirect tangible power (Supreme Court Decision 98Do662 Decided May 12, 1998). The act of allowing a criminal to escape refers to any act that makes it difficult or impossible to exercise criminal justice such as investigation, trial, and execution of punishment by means other than concealment (see Supreme Court Decision 2002Do5374 Decided February 14, 2003, etc.). The following circumstances recognized by the evidence duly adopted and examined by the court below, namely, R et al., police officers’ check before the Korean Press Center building around November 13: 10, 2015:
