Punishment of the crime
"2015 Highest 2589"
1. Around August 21, 2015, the Defendant violated the Road Traffic Act (unlicensed Driving) driving on the part of approximately KRW 1km from the front day of the Han Ging Ging Newspaper, Mapo-gu, Seoul, to the front day of the Cheongnam-ro 47-ro 71, Yongsan-gu, Seoul, without obtaining a driver’s license, on August 16:24, 2015.
2. The Defendant violated the Resident Registration Act was discovered at the date and place indicated in paragraph (1) and sent the F’s resident registration number (G) known to the police officer E, who was requested to verify his/her personal information and present his/her driver’s license, to the police officers belonging to the Seoul Yongsan Police Station D District Unit E, as his/her resident registration number.
In this respect, the defendant used another person's resident registration number unlawfully.
3. The Defendant: (a) entered the name, resident registration number, etc. of F, as described in paragraph (2) by using the PDA device owned by the police officer E at the time and place specified in paragraph (1); (b) prepared a penalty payment notice due to the failure to wear safety; and (c) demanded the Defendant to sign on the PDA device; (b) entered the F’s signature at his own discretion in the column for signing the offender of the above notice; and (c) forged the F’s signature on the column for signing the offender of the above notice; and (d) had the above E, who is aware of the forgery, print out the penalty notice stating the F’s signature.
Accordingly, the defendant forged another person's signature for the purpose of exercising it, and exercised it.
On October 6, 2015, the Defendant 2015 Godan2792, on the 14:40th day of October 6, 2015, the Defendant driven an IBMW car from the front day of the Seodae-dong, Mapo-gu, Seoul, to the front day of the Eunpyeong-gu, Seoul, without obtaining a driving license.
