A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On April 26, 2012, the Defendant was sentenced to eight months of imprisonment for night room, intrusion, theft, etc. in the port branch of the Daegu District Court on April 26, 2012, and completed the execution of the sentence in the port prison on August 5, 2012.
1. On April 23, 2013, the Defendant: (a) around 01:15, at night, went into the house of the victim C of the second floor B in the north-gu, Northern-si; (b) opened a corrected entrance; and (c) intruded by the door open in the house located inside the inside of the house; and (d) carried out cash 35,000 won, which is owned by the victim, using the cresh in which the victim was locked; (b) 35,000 won in cash, which is owned by the victim; (c) 2, 4,000 won in cultural products; and (d) 1, one new card in the name of D.
Accordingly, the defendant invadedd the victim's residence at night and stolen the victim's property.
2. Violation of the Specialized Credit Financial Business Act, and fraud;
A. On April 23, 2013, around 03:12, 2013, the Defendant ordered “F” located in North Korea-gu E at the port and port, and made an employee G, as if he were the nominal owner of the new card that stolen as referred to in the above paragraph (1), to prepare two copies of the card sales slip of KRW 320,000,000, and issued it to the victim upon signing the signature column for the sales slip, and received from the victim, the Defendant issued 320,000,000,000 won or more to the victim.
B. On April 23, 2013, at around 05:21, the Defendant issued an order of alcohol and alcohol to the “I” located in the Northern-gu, Northern-si, the Defendant, as indicated in the foregoing paragraph (1), had the victim J, who is an employee, prepare two copies of the card sales slip of KRW 50,000,000 to the victim by presenting a new card in the name of D, as stated in the foregoing paragraph (1), and then had the victim prepare two copies of the card sales slip of KRW 50,00,000,000, and issued the card to the victim after signing the signature on the column for signature of the sales slip, and received from the victim alcoholic beverages and alcohol equivalent to KRW 50,00.
