The violation of the Act on External Audit of Stock Companies and the offering of bribe to BK.
Reasons
1. The progress of the lawsuit of this case and the scope of the judgment of this court
A. The summary of the facts charged is that the Defendant, from around 1998, engaged in the business of manufacturing rolling stock in the operation of S Co., Ltd. (T as of October 25, 2004, hereinafter “T”) and takes over U.S. Co., Ltd. (hereinafter “U”:V.) around December 2005 in order to expand its business to the ship manufacturing business, and operates T and U, etc. as of now, he has overall control over the business related to the management of W Group (hereinafter “W Group”) such as formulation of business plans, finance, and accounting.
1) On September 20, 2006, the Defendant: (a) requested that AM, located in AO, from the market office of the NO, to explain the necessity for the extension of the shipbuilding yard; (b) “AM,” along with the explanation of the need for the extension of the shipbuilding yard; and (c) stored AM, in a co-fluent bag in which AM was seated and added a letter bag containing USD 5,000 that contained USD 5,00.
B) At the time, the Defendant instructed AP, a U representative, to transfer money to the City Mayor. On October 2006, AP, from the first patrolmen to the first patrolmen on November 2006, instructed AP to explain the need and difficulties for the expansion of a shipbuilding yard at the office of the above NN market, and sealed AM with a letter bag containing US$ 5,000 under the judgment on his customer. As above, the Defendant granted a bribe of USD 20,000 over three times with respect to the duties of the NN market.
2) The Defendant, on August 10, 2007, appropriates his liability in capital on the balance sheet (A) that violates the Act on External Audit of Stock Companies, and falsely made the notice, is situated at Washington.
