A defendant shall be punished by imprisonment with prison labor for three months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On May 14, 2020, the Defendant: (a) around 01:25 on May 14, 2020, the victim D, who was playing a game in the side in the “CPC room” located in B 3th floor of Busan thought-gu, Busan, had 50,000 won of the market price where the victim D, who was playing a game in the side, carried out a string game in order to avoid tobacco.
Accordingly, the defendant stolen the victim's property.
2. Embezzlements of deserted articles in possession;
A. On June 2020, the Defendant acquired a letter of transportation card (Casbee) in a smoking room of the Busan Central Bus Terminal located in 2238 as of the center of Geum-gu, Busan, on June 2020, a person who was unable to know his/her name obtained a letter of 10,000 won, which was charged with the loss of his/her property.
Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
B. On August 12, 2020, the Defendant, around 15:30 on August 12, 2020, acquired a letter of transportation card (T-money) transportation card that is charged with an amount equivalent to KRW 2,000 (T-money) owned by a person whose name is not known, on the roads adjacent to the Busan High-gu, Busan High-gu, 719, as the Busan High-gu, and on the roads adjacent to the Busan High-gu, 719.
Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
