A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On May 12, 2015, at around 23:42, the Defendant driven a B low-speed car while under the influence of alcohol by 0.159% of alcohol without obtaining a driver’s license on the section of approximately 1.5 meters from the road near the Bupyeong-gu Incheon Metropolitan Bupyeong-dong MAI Hospital to the road front of the MAI convenience store located in 1010-1 in the same direction.

2. The Defendant violated the Resident Registration Act, at the time and time stated in paragraph (1) above, used D’s resident registration number as if the Defendant was his/her resident registration number as if he/she was his/her resident registration number, by taking a drinking test from C of the traffic safety department of the Incheon Bupyeong Police Station, which is under influence of drinking on the road prior to the above MAI convenience point, to identify his/her identity.

3. The Defendant: (a) signed the instant D’s circumstantial statement report in the column for the driver’s signature of the Main Drivers’ Statement without authority for the purpose of uttering, acting at the time and place specified in paragraph (2) above; (b) forged a copy of the said D’s circumstantial statement report; and (c) presented it to the Gyeong who knew of the fact that the said document was duly formed on that job.
