A defendant shall be punished by imprisonment for two years.
The defendant shall obtain money from B who is the applicant for compensation 2,100,000 won and the applicant for compensation.
Reasons
Punishment of the crime
1. Around June 3, 2018, the Defendant: (a) put a letter on the Defendant’s house located in Seo-gu, Seo-gu, Gwangju; (b) puts on the AD AE website a sales of a merchandise coupon; and (c) sent money to the Victim AF, who reported and contacted, the Defendant sent the merchandise coupon to the victim AF.
However, even if the defendant received money, he did not have the intention or ability to deliver merchandise coupons.
Nevertheless, the Defendant received a total of KRW 194,285,400 from 51 victims, as indicated in the attached list of crimes, as well as a transfer of KRW 3,651,00 from the AG bank account (H) in the name of the Defendant from the victim.
Accordingly, the defendant deceivings victims to take the property by deceiving them.
2. On May 2018, the Defendant: (a) inserted a letter on the sale of gift certificates on the AD AD AE website at a place where it is not known to a police officer during May 2018; and (b) sent money to the victim AI who reported and contacted, the Defendant intended to send gift certificates to door-to-door.
However, even if the defendant received money, he did not have the intention or ability to deliver merchandise coupons.
Nevertheless, the Defendant received KRW 6,600,000 from the victim to the AG bank account (H) in the name of the Defendant.
Accordingly, the defendant deceivings the victim to take the property by deceiving the victim.
3. On June 24, 2018, the Defendant posted a false statement on the Defendant’s home located in Seo-gu, Seo-gu, Gwangju, to the effect that the Defendant sold the SKS gift certificates on the AD AE site, and that the Defendant would deliver the gift certificates on the first deposit of money to the victim AJ in contact therewith.
However, even if the defendant has received the payment from the victim, he did not intend to deliver the merchandise coupon.
As above, the Defendant, by deceiving the victim as above, acquired KRW 5,00,000 from the victim to the AG bank account under the name of the Defendant on the same day.
