Punishment of the crime
1. 공문서부정행사 B은 2010. 5. 중순경 고양시 일산구 C 지하에 있는 ‘D’유흥주점 앞에서 피고인에게 “너는 앞으로 E이니까 외워라.”라고 말하고 유흥주점에서 신분확인을 할 때 사용하라고 하면서 E의 주민등록증을 건넸다.
A. On May 2010, the Defendant and B received a demand for presentation of a resident registration certificate from an employee who is unable to know the name of the above main office in the above DD entertainment tavern from a policeman.
The Defendant displayed the E’s resident registration certificate under the name of the head of Gwangju Metropolitan City, which is a public document that was possessed by B, as if he were his resident registration certificate.
In this way, the defendant did not use official documents in collusion with B.
B. On August 2010, the Defendant and B received a demand for presentation of a resident registration certificate from an employee who was unable to know the name of the said main office in the “G entertainment tavern” located in Goyang-dong, Seoyang-gu, Yongsan-gu, Busan, for an identification of the Defendant.
The Defendant displayed the E’s resident registration certificate under the name of the head of Gwangju Metropolitan City, which is a public document that was possessed by B, as if he were his resident registration certificate.
In this way, the defendant did not use official documents in collusion with B.
C. On September 2010, the Defendant and B received a demand for presentation of a resident registration certificate from an employee who was unable to know the name of the said main office in the “I” entertainment drinking club located in Goyang-gu, Seoyang-gu, Seoyang-gu.
The Defendant displayed the E’s resident registration certificate under the name of the head of Gwangju Metropolitan City, which is a public document that was possessed by B, as if he were his resident registration certificate.
In this way, the defendant and B did not use official documents in collusion.
2. The Defendant who forged a private document shall be under the C underground of Yongsan-gu, Musan-gu, Muman on May 2010.
