1. Basic facts

A. Pursuant to the former Farmland Reform Act, the Defendant purchased from the Plaintiff the land of this case on March 10, 1962 and completed the registration of ownership preservation in the Defendant’s future on or after March 10, 1962, the land of this case was returned to the Plaintiff by December 31, 1998, as the price redemption and registration of the farmland of this case was completed by the distribution distributor by December 31, 1998, as the farmland of this case was not completed by December 31, 1998, with respect to the land of this case by December 31, 1998, among the land of this case, the land of this case, which was owned by the Plaintiff No. 1,2,3,4,5,67;

B. On December 26, 2013, Plaintiff A filed a lawsuit against the Defendant for cancellation of registration of preservation of ownership on the C Railroad site 8,884 square meters in Namyang-si, including the instant land, with the court 2013Kadan167836, and obtained a favorable judgment on December 26, 2013, and the said judgment was finalized on February 14, 2014.

다. 피고는 이 사건 토지를 철도용지로 사용하기 위하여 1967.경 이 사건 토지 중 별지 3 도면 표시 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, ㄹ¹, ㄷ¹, ㄴ¹, ㄱ¹, ㅎ, ㅌ, ㅍ, ㅇ, ㅅ, ㅂ, ㅁ, ㄹ, ㄷ, ㄴ, ㄱ, 2를 순차 연결한 선내 바 부분 1,113㎡(이하 ‘이 사건 구 D역 부지’라 한다) 내에 철도 레일을 깔고 D역 철도 역사 건물 등을 지은 뒤 나머지 토지 위를 콘크리트로 포장하여 D역 부지로 일반인들의 통행에 제공하였으나, 2005. 4.부터 D역은 폐쇄되고 그 부지는 자전거도로, 공원 등으로 사용되고 있다. 라.

등기부등본상 피고는 이 사건 토지 내에 몰탁벽돌조평지붕평가건 F건물 1동 건평 3평 6홉, 벽돌조 단층 골스레트 지붕 평가건 G건물 1동 건평 8평 1홉, 벽돌조 단층능형스레트 평가건 D역사무실 1동 건평 30평 등 3동의 건물을 소유하고 있는 것으로 기재되어 있으나, 현황은 별지 3 도면 표시와 같이, 같은 도면 ㅋ¹, ㅌ¹, ㅍ¹,...
