A defendant shall be punished by imprisonment for six months.

Punishment of the crime

The defendant is a person who rents a wastewater treatment plant owned by the D industry in Nam-gu Incheon Metropolitan City and substantially operates E.

Since the above wastewater treatment site operated by the defendant is jointly treated with a large quantity of wastewater containing a large quantity of water pollutants discharged from 8 wastewater discharging companies, in treating wastewater, it shall be treated normally through appropriate wastewater treatment process and discharged after being treated normally.

Nevertheless, on April 2, 2012, the Defendant discharged the volume of wastewater containing 61.05mg/liter of wastewater containing 61.05mg/liter of the permissible discharge standards (3mg/liter), 5.846mg/liter of the water-quality pollutants, which is 1.9 times the permissible discharge standards (3mg/liter), 5.846mg/liter of the water-quality pollutants, the total quantity of which is 61.05m/liter of the permissible discharge standards (8mg/liter), 7.6 times the permissible discharge standards (8mg/liter).

In addition, from around that time to May 17, 2012, the Defendant discharged the volume of waste water from a total of 81.9 cubic meters by the same method three times, as shown in the list of crimes in attached Form 1.

Accordingly, the Defendant did not normally operate wastewater prevention facilities without any justifiable reason, thereby discharging water pollutants exceeding the permissible discharge levels.

The grounds for sentencing under Article 76 subparag. 2 of the relevant Act and Articles 76 subparag. 2 and 38(1)4 of the Act on the Preparation of Water Quality and Ecosystem Conservation of Criminal Crimes reflects the defendant's wrongness. However, the wastewater of this case released by the defendant who is in charge of the wastewater treatment business of the Dominiiiiiiiiiiiiiiiis not only exceed the standard value, but also includes metal components and persons, thereby causing significant harm to the human body.
