A defendant shall be punished by imprisonment for two years.

Reasons
Punishment of the crime
[Criminal Justice] On August 31, 2012, the Defendant was sentenced to eight months of imprisonment for fraud in the Daejeon District Court’s Branch Branch, and completed the execution of the sentence in the Daejeon Prison on February 5, 2013.

1. Larceny;
A. On April 19, 2013, between 22:40 to 22:50 on April 19, 2013, the Defendant: (a) performed drinking together with the victim F residing in Seosan-si E; and (b) took a gallon 3 mobile phone 1, cash 40,000 won, agricultural cooperatives, and modern credit cards, and stolen it.
B. On April 20, 2013, the Defendant: (a) withdrawn KRW 900,000,000 in total on three occasions using the said F’s modern credit card owned by the Defendant at a cash payment store located at Pyeongtaek-si, Pyeongtaek-si; and (b) subsequently stolen the same by taking advantage of the said F’s modern credit card.
2. Fraud;
A. On April 19, 2013, the Defendant, at the taxi platform located in the Singudong-dong, Seogdong-dong, Seogdong-si, Seosan, presented the stolen credit card to the victim, such as paragraph 1(a), as one of its legitimate owners, and acquired and acquired pecuniary benefits equivalent to the amount of the taxi fee of KRW 100,000 from the 23:04 to the 2nd Dong-dong, Seosan-si.
B. On April 20, 2013, around 00:33, the Defendant acquired and fraudulently acquired pecuniary benefits equivalent to the amount of money by presenting the stolen credit card to the victim-in-fact owner, such as paragraph 1(a), as if he/she was his/her own legitimate ownership, as the Defendant presented the stolen agricultural credit card to him/her as if he/she were the victim-in-fact owner.
C. On April 20, 2013, around 03:28, the Defendant presented 150,000 won, including the fee for singing practice room, to the owner of an I K K-sing room located in Boan City, G, as stated in paragraph 1(a), with a stolen agricultural credit card, as stated in paragraph 1(a), as one’s own legitimate ownership.
