Punishment of the crime
[2014 Highest 1478]
1. On November 11, 2013, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) received a summary order of KRW 2 million as a penalty for larceny and a violation of the Specialized Credit Financial Business Act from the Suwon District Court.
On April 8, 2014, around 18:16, the Defendant stolen the credit card of the victims ten times in total, from around 11:50 on June 30, 2013 to April 11:00, as shown in the annexed Table 1, the victim C was placed on the payment date, and discovered and stolen the NH fitness card (D) owned by the victim.
2. On April 20, 2014, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) presented a stolen credit card on his/her own account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account-based account; (b) had the said employee pay the price of the goods using the said card; (c) received three 49,700 won in total at the market price of the victim’s account-based account-based account-based account-based account-based account-based account-based account;
In addition, from June 30, 2013 to April 14:55, 2014, the Defendant purchased goods equivalent to KRW 4,700,200 in total using a stolen credit card over 11 times, as shown in attached Table 2, from around 12:16 to April 20, 2014, and acquired it or acquired it through fraud or used a stolen credit card over 10 times.
[2014 Highest 1871] On April 8, 2013, the Defendant presented the NH source card (credit number D) owned by C, which was stolen to an employee on the account-based calculation unit, at the e-mail store located in the e-mail 3-dong, Seocheon-gu, Seocheon-gu, Busan, to the said employee as his/her card, and caused the said employee to pay the price of the goods by the said card.
