[Defendant A] Defendant A shall be punished by imprisonment with prison labor for ten months.

However, the above sentence shall be executed for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2014 Highest 314] Defendant A is a person who, along with D, operated a game room without a trade name in Hosi-gu Gtel 610 from March 28, 2013 to August 2013, and from November 28, 2013 to December 3, 2013. Defendant B is a person who worked in the above game room for the same period. Defendant C is an employee from November 28, 2013 to December 3, 2013.

1. No person who commits a crime by conspiracy in Defendant A or Defendant B shall provide information on the distribution or use of game products which have not been rated, or display or keep such products for such purposes, and shall exchange, arrange for exchange or repurchase the results of tangible or intangible obtained through the use of game products or conduct business of repurchase thereof;

Nevertheless, from March 2013 to August 2013, Defendant A and Defendant B conspired with D, the said game software rating committee established 12 game software players whose rating was refused from the said game software rating committee and provided them for the use of unspecified customers, and made cash exchange by customers after deducting 10% fees from the points obtained from the use of the game.

2. No one shall provide the Defendants with the distribution or use of game products which have not been classified by the Defendants, or display or keep such products for such purposes, and shall exchange, arrange for exchange or repurchase the results of tangible or intangible obtained through the use of game products or engage in business of repurchase thereof;

Nevertheless, the Defendants conspired with D, from November 28, 2013 to December 3, 2013, set up 12 game software games, the rating classification of which was refused by the Game Rating Board in the said game site, provide many and unspecified customers with the game, and they acquire them through the use of the game.
