A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. In the Ministry of Agriculture and Forestry in violation of the Subsidy Management Act, the Ministry of Agriculture and Forestry implemented a project to provide subsidies for discontinuance of business for items deemed difficult to continue the business of cultivating, raising, catching, collecting, or cultivating fruit trees, horticultural, livestock, fishery products, etc. due to the implementation of the Free Trade Agreement pursuant to the "Special Act on Assistance to Agricultural and Fishery Business Operators, etc. Following the Conclusion of the Free Trade Agreement" if a farmer or fishery business operator closes his/her business.

On June 7, 2013, the Defendant: (a) filed an application with the Gun Office, which is located in the Gun Office, for the closure of the livestock farming business; (b) filed an application with the Gun Office, for the closure of the livestock farming business; and (c) filed an application with the Gun Office, around December 2013, the Defendant submitted to the Gun Office, the recipient of the support fund for the closure of the business, stating that “The recipient of the support fund for the closure of the business cannot directly raise, or receive the entrustment from, his livestock pens or any third person, for the next five years.”

However, even after receiving the subsidy for discontinuance of business, the defendant thought that he continued to raise Korean-style cattle at a stable in Gun E.

Defendant filed a false application as above and received KRW 67,784,00 from the Gun Office around December 29, 2014 as subsidies for discontinuance of business.

As a result, the Defendant received subsidies by false application or other unlawful means.

2. A person who intends to engage in breeding business, the area of which exceeds 300 square meters, shall obtain permission from the head of a Si/Gun/Gu having jurisdiction over the relevant place of business by preparing matters concerning the adequate number of breedings per unit area and the number of breedings prescribed by Presidential Decree, as prescribed by Presidential Decree.

The Defendant without obtaining permission from the Defendant F along with the Defendant F’s children from February 23, 2015 to December 9, 2015.
