1. 공소사실 피고인은 2012. 9. 14. 10:42:09경 경산시 B건물 303-906호 피고인의 집에서 인터넷 커뮤니티 일간베스트저장소 (www.ilbe.com)에 피고인의 닉네임 ‘C’로 접속하여 위 사이트의 짤방 게시판에 게시된 '[재업]개도둑년 지랄도풍년.Gisa alpha '라는 제목의 글에 ‘말로만 듣던 개도둑년이네 ㅋㅋㅋㅋㅋㅋㅋㅋㅋ'라는 댓글을 기재하여 공연히 피해자 D을 모욕하였다.

2. The instant facts charged constitute a crime falling under Article 311 of the Criminal Act, which can be prosecuted only when a complaint is filed under Article 312(1) of the Criminal Act. According to the written withdrawal of a complaint filed in the records, the victim may recognize the fact that the complaint against the Defendant was withdrawn on May 15, 2013, which was after the instant indictment was instituted. Thus, the instant indictment is dismissed pursuant to Article 327 subparag. 5 of the Criminal Procedure Act.
