Punishment of the crime

피고인은 2020. 8. 22. 01:30경 대구 수성구 B 소재 대구수성경찰서 C지구대에서 폭행 혐의로 현행범 체포되어 지구대 내에 인치되어 있던 중 피고인이 임의로 지구대를 이탈하려고 하여 위 C지구대 소속 경위 D가 피고인의 이탈 방지를 위하여 피고인에게 수갑을 채우려고 하자, 위 경위에게 “씨발놈아 나는 가겠다 짭새 새끼들”이라고 욕설을 하면서 지구대 밖으로 나가려고 하였고 이에 위 경위가 재차 피고인의 행동을 제지하자 주먹으로 위 경위의 코 부위를 1회 때려 폭행하는 등 경찰관의 현행범 체포 및 인치에 관한 정당한 직무집행을 방해하였다.
