A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant purchased documents necessary for the application for special supply of the new mixed book from the new mixed book having no actual intent and ability to sell the apartment, filed an application for special supply of the new mixed book in its name, and acquired the proceeds from resale by selling the apartment in its name. In that process, the Defendant was willing to submit the medical certificate as if the above new mixed book were pregnant, and submitted the medical certificate as if it was completely prepared after forging the medical certificate as if it were pregnant.

1. Regarding Incheon apartment housing C

A. On October 2017, the Defendant violated the Housing Act: (a) received from D documents necessary for the application for the special parcelling-out of the subscription passbook and the personal seal impression to D, stating that “The transfer of documents, such as the passbook and the certificate of personal seal impression necessary for the application for the special parcelling-out of the shared book.”

Since then, around October 31, 2017, the Defendant applied for the special allotment of the new apartment unit D in the name of Yeonsu-gu Incheon apartment model house B in Yeonsu-gu Incheon Metropolitan City, for the special allotment of the new apartment unit D, by using the above documents, and D won won the above apartment unit C, and sold the above sale right to E around May 17, 2018.

Accordingly, the defendant acquired the house savings certificate in the name of D in order to be supplied with housing constructed and supplied under the Housing Act.

B. On October 2017, in order to increase the additional points of offer of D by the nominal owner of the above subscription passbook, the Defendant drafted a diagnosis document with respect to F while preparing a diagnosis document with respect to F, “F”, “(H), “(s) 9 weeks of disease” in the patient’s name column, “G Uins of disease” in the medical institution name column, “Gins of disease”, and “Gins of disease” in the medical institution name column, and “Gins of disease” and “G” in the name column.
