A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

B은 속칭 ‘떴다방’ 업자로서, 피고인, C, D, E, F, G, H, I, J 등 모집책과 신혼부부, 다자녀 가구, 무주택자 등 아파트 특별공급 청약 신청 요건을 갖추었으나 경제적 능력이 부족하여 분양신청을 할 수 없는 대상자를 물색하여 이들로부터 입주자저축증서인 주택청약종합저축통장(이하 ‘청약통장’이라고 한다) 및 청약신청 관련 서류(인감증명서, 주민등록등본, 가족관계증명서 등)를 매입하고, 청약통장 명의자들을 아파트 분양 지역으로 위장전입시키고, 청약신청을 통해 아파트를 분양받아 전매하는 등의 방법으로 수익을 얻기로 공모하고, 피고인 등은 청약통장 명의자들로부터 공인인증서, 청약통장, 계좌번호, 비밀번호 및 인감증명서 등 아파트 청약에 필요한 서류를 양수하여 위 B에게 전달하고, 위 B은 양수대금을 제공하고, 청약통장 명의자들을 아파트 분양 지역에 위장전입시키고, 청약신청을 통해 아파트를 분양받아 전매하는 역할을 담당하였다.
