Defendant shall be punished by a fine of KRW 1,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. Forgery of private documents and the display of private documents;
A. On December 31, 2013, the Defendant: (a) made use of a pen in SK Telecom C in the Nam-gu Incheon Metropolitan City, stating “D, E, Incheon, F 102 Dong-dong 402,” and “D” to the customer column; (b) forged one copy of a new service contract in the name of D, which is a private document concerning rights and duties, for the purpose of exercising the customer column by signing the contract as “D; and (c) exercised it by delivering a forged new service contract to SK Telecom employees who are aware of the forgery at the same time and at the same place by facsimileing it as if the new service contract was duly concluded.
B. On January 8, 2014, the Defendant forged one copy of a new service contract under the name of D, which is a private document concerning rights and obligations, for the purpose of exercising by stating “D” in the customer column of a new service contract kept at the same place via the pen at the above place, and signed “D” in the customer column of the application for subscription, and used it at the same time and at the same place by sending the forged service contract to SK Telecom employees who are not aware of such forgery by facsimile as if they were duly concluded.
2. The Defendant, as a result of each act described in paragraph (1), deceivings the victim as if the victim D opened a mobile phone, to the fact that the application for new subscription was made to the telecommunications company, and received two mobile phone terminals from the above store manager at around that time in total amount of KRW 1,181,400, respectively.
