Reasons
Punishment of the crime
1. Defendant A, Defendant B, and Defendant C conspired to sell horse racing in real time, which shows the horse racing supervised by the Korean Racing Association, and to make profits from the sale of horse tickets via the Internet, and Defendant A planned to take charge of the management of horse tickets, including, but not limited to, the so-called general responsibility for the operation of the private horse site and the management of funds. Defendant B and Defendant C planned to assist the site operation and transfer dividends to the purchaser of the private horse horse racing tickets in accordance with the results of the competition on a gold day, Saturday, and Sundays where the horse horse game is being conducted, and where profits occur, the transfer of dividends to the purchaser of the private horse horse racing tickets and withdraw them in cash, respectively.
Accordingly, on November 1, 2013, the Defendants operated the private horse site called "K" at the private horse office located in Pyeongtaek-si J of Pyeongtaek-si on November 1, 2013, transferred KRW 2,000,000 to the account (Account Number: M) of Defendant A for the purchase price of the horse tickets from the names of members in the name of "L" to the account in the name of Defendant A for the purchase of the horse tickets, and sold the horse horse tickets. In the event that the horse horse was loaded after the completion of the racing, the Defendants paid dividends according to the dividend rate set by the Korean Racing Association and accumulated 10% of the purchase price of the horse tickets in the game machine even if the horse was not loaded, and paid dividends from around that time to April 5, 2014 to around 21,608,500,000 won in total, or received dividends from members in the game machine in the total of 2,610 to around 50,508,000.
As a result, the Defendants conspired to commit an act similar to the horse riding voting in relation to the racing conducted by a marina society, thereby paying the benefit of property to the enemy.
2. Defendant D is well aware of the fact that the above Gap et al. committed a similar act at the same time and place as above.
