Reasons
Punishment of the crime
1. A person who intends to engage in credit business, etc., is registered with the competent authority having jurisdiction over the pertinent place of business, but the Defendant did not register the credit business, and around January 12, 2018, the Defendant run unregistered credit business in a way that: (a) lent KRW 2 million to D from “C” located in Busan-gu Busan-gu, Busan-do; (b) paid KRW 1.8 million after deducting 200,000 won from fees; and (c) paid the principal and interest for 40,000 won a day to be repaid in equal days.
2. The highest interest rate shall not exceed 25% per annum when a unregistered credit service provider makes a loan. However, around January 12, 2018, the Defendant paid 1.8 million won, deducting 200,000 won as a fee, and paid 40,000 won per annum by stipulating that the principal and interest shall be repaid in 65 days per day by equal days, and the interest shall be paid in excess of 25% per annum by paying interest equivalent to 436.7% per annum.
3. No debt collector who violates the Fair Collection of Claims Act shall assault, threaten, arrest or detain a debtor or his/her related person in connection with debt collection, or use a deceptive scheme or force against him/her;
