1. The plaintiff's appeal is dismissed.

2. The costs of appeal shall be borne by the Plaintiff.

The purport of the claim and appeal is the purport of the appeal.

Reasons

1. Facts of recognition;

A. On December 9, 2008, the Plaintiff entered into a sales contract with the Defendant for purchasing KRW 1.2 billion from the Defendant (hereinafter “instant sales contract”) of KRW 1,233 among the real estate listed in the separate sheet (a total area of KRW 9,115 square meters; hereinafter “instant land”) and each of the real estate listed in the separate sheet (hereinafter “instant land”). The Plaintiff agreed to pay KRW 240 million by the end of February 2009, the remainder of KRW 360 million by the date determined by the Plaintiff in consultation with the Defendant, and the date the ownership is transferred in the name of the Defendant.

B. On December 11, 2008, the Plaintiff paid 120 million won out of the down payment of KRW 240 million as stipulated in the instant sales contract to the Defendant.

C. From December 23, 2008 to March 30, 2012, the Plaintiff wired a total of KRW 480 million to the deposit account in the name of the Defendant (hereinafter “instant deposit account”) at least 40 times as follows.
