Reasons

1. Basic facts

A. On December 9, 2008, the Plaintiff and the Defendant concluded a sales contract for the Plaintiff to purchase KRW 1.2 billion from the Defendant’s KRW 1.2 billion among the real estate listed in the separate sheet (hereinafter “instant land”) by the end of February 2009, the Plaintiff and the Defendant agreed to pay KRW 360 million for the remainder of KRW 60 million by the date determined by the Plaintiff and the Defendant’s consultation, and for the remainder of KRW 600 million by the date of transfer of ownership.

B. On December 11, 2008, the Plaintiff paid 120 million won out of the down payment of KRW 240 million as stipulated in the instant sales contract to the Defendant.

C. From December 23, 2008 to March 30, 2012, the Plaintiff wired the sum of KRW 465 million to the account in the name of the Defendant for 39 times as follows (hereinafter “amount of instant division remittance”).
