A defendant shall be punished by imprisonment with prison labor for not more than ten months.

The evidence seized shall be confiscated from the accused.

Punishment of the crime

On April 4, 2007, the Defendant was sentenced to a suspended sentence of three years and six months for a violation of the Act on the Control of Narcotics, etc. (mariju) at the Incheon District Court, and nine months for a violation of the Act on the Control of Narcotics, etc. (mariju) at the Jung-gu District Court on February 3, 2012.

No person shall smoke or possess marijuana.

Around December 24, 2018, the Defendant committed a smoking act of marijuana around December 24, 2018: (a) around 21:00, at the Defendant’s residence located in Goyang-gu B lending C, Goyang-gu, Goyang-gu; (b) made a cigarette package, the package of which belongs to a cigarette, and (c) made a cigarette 0.5g of marijuana at his/her own charge, and smoked in a manner of inhaleing the smoke by attaching a raz fire.
