1. The defendant (Counterclaim plaintiff)'s counterclaim of this case shall be dismissed.
2. The Defendant (Counterclaim Plaintiff) is against the Plaintiff (Counterclaim Defendant).
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Facts of recognition;
A. On June 11, 1965, E had owned the land owned by the Plaintiff before entering into an exchange contract, after completing the registration of ownership transfer with respect to 187 square meters in Yong-do, Yong-do. However, on July 28, 1992, E was divided into 153 square meters from the above land and became H land in Gyeong-gu, Gyeong-do, Gyeong-do. The remaining 34 square meters are 112 square meters (hereinafter “I land”) in Gyeong-do, Chungcheongnam-do, Gyeong-do, Gyeong-do, by converting the land into a site.
(2) On July 30, 1992, the Plaintiff had completed the registration of ownership transfer on the ground of sale on July 14, 1992 in the name of the Plaintiff on July 14, 1992; 2) E had owned the registration of ownership transfer on the land of 6,744 square meters in the Gyeong-si, Gyeong-do; on June 30, 1995, the forest land was divided into 107 square meters in the above land and J 107 square meters in the Gyeong-do, Gyeong-do; on June 30, 1995, the Plaintiff had to file an application for registration of ownership transfer on the land of 107 square meters in the 107 square meters in the Y-si, Y-si, Y-do, and Y-si, Y-do, and the registration of ownership transfer on the land of 107 square meters in accordance with the former Act No. 4502, Nov. 30, 1992.
3) L was subject to registration conversion on November 20, 1937 with 694 square meters of Ma forest land, Ma-do, Yan-do (Nan-si, Do, Gyeongnam-do on June 19, 1996) and with 654 square meters of Ma-do, Yan-do.
The registration of ownership transfer with respect to A was completed and owned, but on June 19, 1996, a 115 square meters was divided from the above land and became a F 115 square meters in Gyeong-si, Gyeong-do, Gyeong-do, Gyeong-do, and on May 26, 1997, the F 115 square meters in Gyeong-do.
