1. Basic facts

A. On December 31, 1964, in accordance with the former Act on Special Measures for the Registration, etc. of Ownership of General Farmland (amended by Act No. 1657 of Sep. 17, 1964), the registration of ownership transfer was completed in the Defendant’s future on March 5, 194, for the reason of sale on March 5, 1949.

B. The D land before subdivision is divided into F. F. 157 square meters, C. 196 square meters, and G 148 square meters (the land category was changed to “responding”) before G. On January 26, 1976, the land was divided into 116 square meters before H and 264 square meters before C. 264 square meters (hereinafter “B before subdivision”).

C. On June 22, 1985, the ownership transfer registration (hereinafter “instant ownership transfer registration”) was completed on April 5, 1974 in accordance with the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (wholly amended by Act No. 3562, Apr. 3, 1982; hereinafter “Real Estate Special Measures Act”) with respect to the land B before subdivision, and the land category was changed to a building site on September 24, 1992. On February 6, 2009, the land category was divided from C to 25 square meters and divided from C’s land before subdivision to 39 square meters (hereinafter “the instant land”).

원고와 피고는 형제 사이인데, 형인 피고는 아버지 J이 1968. 10. 9. 사망한 이후인 1974년경 분할 전 C 토지 위에 주택을 신축하여 자신의 처 및 직계비속, 자신의 어머니 K, 동생인 원고와 함께 거주하였고, 1980년경 원고가 분가한 이후 위 주택에서 처 및 직계비속과 계속 거주하다가, 분할 전 C 토지에 관하여 원고 앞으로 이 사건 소유권이전등기가 마쳐진 1985. 6. 22. 무렵 종전 주택을 개축하여 이 사건 변론종결일까지 이 사건 토지 중 별지 도면 표시 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 5의 각 점을 순차로 연결한 선내 ㈎ 부분...
