[Defendant A] The defendant shall be punished by imprisonment for three years.

However, the above sentence shall be executed for four years from the date this judgment became final and conclusive.

Punishment of the crime

As Defendant A urged to pay a debt amounting to approximately KRW 300 million and fails to meet the living expenses, Defendant A, using a yellow pond (one name): around December 26, 2019, has taken the place in a high-class house and office around Gangnam-gu Seoul Metropolitan Government, with a view to theft of cash and a master book.

1. From 20:28 on December 26, 2019 to 20:31 on the same day, the Defendant: (a) came to fall under the E apartmentF of the victim D residing in Seocho-gu Seoul Metropolitan Government; (b) was worn out the front cover; (c) was removed from the door for travel; (d) was cut off the door from the door; and (e) was destroyed by using the front cover; and (e) the Defendant attempted to steal money and valuables by entering the said victim’s residence; and (e) was attempted to commit an attempted charge out of the said match, based on the belief that the money and valuables were to be cut off.

Accordingly, the defendant tried to steals property by destroying door at night and impairing the structure in which the victim resides, but he did not commit an attempted crime.

2. From December 26, 2019 to December 21:12, 2019 on the same day, the Defendant: (a) fell under the I building J, the office of managing the victim H located in Seocho-gu Seoul Metropolitan Government, and destroyed the entrance by using the lava, wearing a lock gate prepared in advance, as described in paragraph (1), and then, (b) destroyed the entrance by using the door lava, and (c) was stolen by putting approximately KRW 80,000,000 in cash owned by the victim, entering the said victim’s management office.

Accordingly, the defendant stolen property by damaging door at night and impairing the structure in which the victim resides.

3. On December 22, 2018, the Defendant: (a) at L offices located in Young-gu, Young-gu, Young-gu, K around December 22, 2018; (b) at L offices located in Young-gu; (c) at M’s employees N, for two years, leased the P Leraber leased from M Co., Ltd. to M Co., Ltd., for two years, between the 17th to 19th day of each month.
