A defendant shall be punished by imprisonment for a year and February of one year and a fine of 300,000 won.

The defendant does not pay the above fine.

Punishment of the crime

[Criminal Power] On January 14, 2015, the Defendant was sentenced to eight months of imprisonment with prison labor for obstruction of performance of official duties by deceptive means, etc. at the Busan District Court on August 28, 2016, and completed the execution of the sentence in the Busan Correctional Institution.

【Criminal Facts】

The Defendant is a person who has continued to interfered with the business of nearby small-scale merchants under the influence of alcohol at a restaurant or a main store operated by women in Busan, Seo-gu.

1. On September 20, 2018, at around 06:00 on September 20, 2018, the Defendant interfered with his/her duties, following the following year: (a) around 06:00, at the “Dcafeteria” operated by the Victim C, the victim C, who was aware of the next seat, was engaged in drinking to drinks; (b) he/she did so; (c) but was refused by customers; and (d) the customer was able to take a bath for customers; and (d) he/she obstructed the victim’s restaurant business by force.

1. From November to December 16, 198 to the same method, the victims’ main points and restaurant businesses were obstructed by force over 14 times in total, as shown in the attached list of crimes.

2. Performance of official duties by deceptive means.

A. On January 11, 2018, at least 05:41, the Defendant: (a) falsely reported to the effect that, despite having sold alcoholic beverages for domestic use, two police officers, such as F, etc., who belong to the Busan Casa Police Station E box, sold alcoholic beverages for domestic use at the front of the D restaurant located in the Busan Casa-gu B, Busan, to the effect that “I are selling alcoholic beverages for domestic use.”

B. On October 4, 2018, at around 02:25, the Defendant reported to the effect that “the said restaurant is a proprietor in the restaurant,” in 112, even though he/she did not complete the business on the front of the H restaurant located in the Busan Seo-gu G, the Defendant reported it falsely to the effect that “the said restaurant is located in the restaurant,” and the two police officers, such as I, etc., assigned to the Busan Seo-gu Police Station Estation, were not necessary

Accordingly, the defendant is about the prevention of crimes by the police officers and the protection of the lives and bodies of the people through a deceptive scheme twice in total.
