A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Indecent Acts such as soldiers;

가. 피고인은 2019. 10. 중순 17:00 경 경북 영천시 B에 있는 C 사단 D 본부 3 층 샤워 장에서 피해자 일병 E과 함께 샤워를 하던 중 피해자의 뒤로 다가가 갑자기 자신의 손가락으로 피해자의 항문 사이를 위아래로 � 어 만져 군인인 피해자를 강제로 추행하였다.

B. The Defendant’s rank at the end of November 2019 around 17:00

1. (a) In the shower room as described in paragraph (1), the victim, who is a soldier, was forced to commit an indecent act by bringing his sexual organ to the victim’s bet E.

피고인은 2019. 12. 초순 21:00 경 경북 영천시 B에 있는 소속대 수송 1 생활관 앞 복도에서 야간 점호 집합 당시, 피해자 일병 E의 뒤에 서서 신음소리를 내며, 갑자기 자신의 혀로 피해자의 귀를 핥고 바람을 불어넣어 군인인 피해자를 강제로 추행하였다.

On December 2, 2019, the Defendant: (a) dumpeded the victim’s disease E, who was in contact at the time of personal maintenance at the first living room for the transport of the fleet located in the Seocho-si, Gyeongcheon-si; and (b) dumpddd the victim’s sexual base before and after the victim’s body so that the victim’s sexual base part can be closely aware of the victim’s body, and committed an indecent act by force on the part of the soldier.

2. On December 2, 2019, the Defendant assaulted the victim E at around 15:00, the Defendant used approximately 1m distance from the Defendant in transportation of the 1st century located in Yongcheon-si, Chungcheongnam-si, Gyeongcheon-si, Gyeongcheon-si, with the victim E at approximately 1m of the Defendant. The Defendant used the victim’s right eyebrow to the victim’s right eye by spraying the flad with the flick.

Accordingly, the Defendant, carrying a dangerous object with a shoulderer and a flaco, and assaulted the victim.
