Punishment of the crime

The defendant was elected at the first simultaneous election of the head of a cooperative throughout the country, which was implemented on March 11, 2015, as a candidate for the head of a cooperative of agricultural cooperatives.

An election campaign may be conducted only from the day following the deadline for the registration of candidates ( February 25, 2015) to the day preceding the election day ( March 10, 2015).

1. 피고인은 2014. 4. 14.경 불상지에서 조합장 선거에 출마 예정인 피고인의 인지도를 높이기 위하여 피고인의 휴대전화(D)로 위 C 농협의 조합원인 E의 휴대전화(F)에 피고인의 사진과 함께 “E 조합원님 생일 축하드립니다. 뜻 깊은 오늘 가족 모두 즐겁고 행복한 하루되십시오. ♬ 전) C 농협 상무 A 올림”이라는 문자메시지를 전송한 것을 비롯하여, 2014. 11. 1.경 불상지에서 위 C 농협의 조합원인 G의 휴대전화(H)와 2015. 1. 9.경 불상지에서 위 C 농협의 조합원인 I의 휴대전화(J)에 각각 같은 방법으로 같은 내용의 문자메시지를 전송하여 선거운동 기간 전 선거운동을 하였다. 2. 피고인은 2015. 2. 8.경 불상지에서 피고인의 위 휴대전화로 위 C 농협의 조합원인 K의 휴대전화(L 에 전화하여 “안녕하십니까. 저는 C농협에 근무했던 A이라고 합니다. 조합원님 마침 생일이시고 축하도 드릴겸, 제가 이번에 조합장으로 출마하려고 합니다. 그래서 인사도 드릴 겸 전화를 드렸습니다. 3월 11일날 잊어버리지 마시고 도와주세요, 집은 M이고, A 입니다. 좋은 하루 되십시오”라고 지지를 호소하는 말을 한 것을 비롯하여 그 때부터 선거운동 기간 전일까지 조합원 260여 명에게 지지를 호소하는 전화를 하여 선거운동 기간 전 선거운동을 하였다.
