그런데도 피고인은 선거운동 기간 전인 2015. 1. 13. 09:00경 전북 부안군 D에 있는 자신의 주거지 안방에서 인터넷을 이용하여 문자메시지를 발송 사이트인 ‘문자 천국’ 사이트에 접속한 후 자신을 홍보하고 지지를 부탁할 목적으로 발신번호에 피고인의 휴대전화 번호(E)를 입력한 뒤 위 농협 조합원 F 등 912명에게 “안녕하세요. A입니다. 찾아뵙고 인사를 드려야 도리인데 선거법 때문에 뵙지 못함을 용서 바랍니다. C농협 이사 4선, 감사 3선 23년간의 경험으로 이번 조합장 선거에 출마하려 합니다. 풍부한 경험과 강한 업무 추진력으로 합병 대상인 C농협을 기필코 지켜내겠습니다. 기회가 된다면 뵙고 싶습니다. 항상 건강하시고 행복하세요. -C농협 감사 A 배상-”이라는 내용의 문자메시지를 발송하였다.
