1. The defendant shall be punished by a fine of four million won;
2. If the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
From March 2012 to September 2013, the Defendant is a dentist who served as the representative director of the “E dental clinic” on the fourth floor of the building D on the Busan Jin-gu, Busan.
1. On December 1, 2012, F prepared a false medical certificate: (a) the E dental clinic received both artificial coloning surgery Nos. 36 and 37 at the above E dental clinic; (b) in order to additionally receive insurance proceeds by using the fact that the insurance proceeds he/she purchased to Samsung Life Insurance Co., Ltd. are paid for each frequency of artificial colon transplantation, the F requested the above hospital to issue a medical certificate; and (c) to request the above hospital to separately implement artificial coloning surgery No. 36 and 37.
The Defendant received a report from the staff in charge of G, etc., who is the head of the counseling office of the above hospital, and knew of these circumstances, the Defendant, at the above hospital on February 26, 2013, made it possible to prepare and issue a certificate of diagnosis containing the content that the Defendant carried out each artificial dental transplantation to F on December 1, 2012 at the hospital No. 36, and No. 37, Dec. 8, 2012.
In addition, during the period from September 6, 2013 to September 6, 2013, the Defendant prepared each written diagnosis through G, etc. at least eight times as shown in attached Table 1.
2. On December 1, 2012, when both E dental clinic Nos. 36 and 37 received artificial ashypt transplant, the F filed a claim for insurance proceeds with the victim Samsung Life Insurance Co., Ltd. on March 14, 2013, accompanied by a medical certificate containing false details. The Defendant received KRW 1 million from the damaged person for transfer as insurance money on March 15, 2013, and received the said false medical certificate from the Defendant to F through G, etc., thereby facilitating F to commit the said crime.
In addition, from that time until September 25, 2013, six persons, such as F, etc., as shown in attached Table 2, from that time to that of September 25, 2013, including two victims.
