A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2013. 7. 10. 23:20경 창원시 마산합포구 C에 있는 자신의 주거지 앞길에서부터 D 렉서스 승용차를 운전하여 같은 구 월영동에 있는 부성빌라 앞 도로까지 술을 마신 상태에서 운전 중 위 부성빌라 앞 도로에서 음주운전 단속 근무를 하던 마산중부경찰서 E지구대 경사 F이 실시한 음주감지기 검사에 음주감지(high-높음)가 되어 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어 위 경사 F으로부터 약 30분간에 걸쳐 음주측정기에 입김을 불어 넣는 방법으로 음주측정에 응할 것을 요구받았음에도 음주측정기의 불대를 혀로 막으며 입김을 불어넣는 시늉만 하는 방법으로 이를 회피하여 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 아니하였다.
