A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant was a person who operated a mobile phone sales agency in the name of “C” in Daegu-gu, Seo-gu, Seoul-gu.

1. Crimes committed on May 19, 2016;

A. A. Around May 19, 2016, the Defendant forged a private document and the instant investigation document: (a) stated “D”, “F”, “E”, “G”, and “G” in the name column of the legal agent of the legal agent of the written consent of the minors in the letter of consent; (b) stated “E” and “D” in the said new contract’s legal agent column; and (c) issued E and/or D’s signature on the next new contract’s legal agent column; and (d) delivered the said contract as if it was genuinely formed to the employees of the SK Telecom Co., Ltd., regardless of its forgery.

Accordingly, for the purpose of exercising authority, the Defendant forged a new contract for the TPP Youth Mobile Call in the name of D and E, which is a private document on rights and obligations without authority, and exercised it.

B. Although the Defendant did not obtain the consent of opening of a mobile phone from D or E on the above date, place, and fact, the Defendant submitted the above new contract under the above names D or E as if he obtained the consent, and submitted it to the victim SK Telecom Co., Ltd.’s non-indicted 712,040 won of the market price to the victim SK Telecom Co., Ltd. and obtained the above mobile phone, and the Defendant did not use the above mobile phone and did not pay 413,960 won of the user fee, thereby acquiring property benefits equivalent to the same amount.

2. Crimes committed on August 30, 2016;

A. The Defendant, around August 30, 2016, issued a private document forgery or the instant investigation document to request the revocation of the opening of a mobile phone, and the issuance of the H’s resident registration certificate, which was found in the “C” around August 30, 2016, to the customer name column of “H” and “I” and “I” and “I” and “I” on the date of birth.
