Defendant shall be punished by imprisonment with prison labor for one month and by imprisonment for the remaining crimes as set forth in the judgment of the first instance among the cases of 2017 order3604.
Reasons
Punishment of the crime
On September 13, 2002, the Defendant was sentenced to two years of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the Incheon District Court. On October 6, 2005, the same court was sentenced to two years of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes. On December 17, 2009, the court was sentenced to three years of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes. On March 14, 2013, the execution of the sentence was terminated. On June 29, 2016, the Daejeon District Court sentenced ten months of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, which became final and conclusive on July 7, 2016.
"2017 Highest 3604"
1. Around April 2015, the Defendant: (a) discovered a copy of the C convalescent Card Co., Ltd. (hereinafter “Co.”), which was located at the C convalescent Co., Ltd. (hereinafter “C convalescent”); and (b) stolen the said Victim’s Cvalescent Card with a crepit in which the said Victim’s Management was neglected.
2. From April 19, 2017 to April 19, 2017, the Defendant violated the Specialized Credit Financial Business Act: (a) purchased a stolen electronic card at G convenience store located in Seo-gu Daejeon, Seo-gu, Daejeon; (b) and (c) used the stolen electronic card to use the stolen electronic card and obtain pecuniary benefits equivalent to the same amount by requiring the said H to pay 13,000 of the price, as stated in paragraph (1), at the convenience store located in Seo-gu, Daejeon; (c) used the stolen electronic card over 28 occasions in total; and (d) acquired the same amount of monetary benefits by requiring H to pay the price 13,000; and (e) from April 13, 2017 to April 19, 2017.
3. On July 26, 2017, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes, etc. (thief) in the J located in Seo-gu, Daejeon on July 17:30, 2017, and there is a gap in monitoring the Victim K, a manager of the said area.
