A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment became final and conclusive.

피고인은 2015. 1. 3. 20:35경 대구 수성구 달구벌대로 3173(매호동)에 있는 코오롱스포츠 매장 앞길에서 피해자 B(67세)이 운전하는 택시에 승객으로 탑승하여 목적지를 말하였으나 피해자가 이를 알아듣지 못한 채 재차 물어 본다는 이유로 화가 나 피해자에게 "십할놈아 한번 캤으면 됐지. 임마, 십할놈아. 차세워."라고 욕설을 하면서 피해자를 택시에서 내리게 한 다음 주먹으로 피해자의 얼굴 부분을 수회 때려 피해자에게 약 6주간의 치료가 필요한 폐쇄성안와상골절 등 상해를 가하였다.
