Reasons
Punishment of the crime
1. A council of members of a political party jointly committed by Defendants A, B, and C shall not make any contribution to the election concerned for a candidate (including a person intending to become a candidate) or a political party to which he belongs, before the election period, and no one shall make, or have another make, a contribution to the election for a candidate (including a person intending to become a candidate) or a political party to which he belongs; and
Defendant
A is the chairperson of the Council for Party Members of H to E (F on February 17, 2020 after the instant case, and each change of name to “G” on September 2, 2020; hereinafter the same shall apply). Defendant B is the chairperson of “I” located in H, and Defendant C is the “J” member located in H.
K is a member of the 20 L constituency to which he belongs, and a person who was elected after the registration of a preliminary candidate around February 17, 2020 and around March 26, 2020 in the same constituency in the 21st National Assembly member election implemented on April 15, 2020.
On February 15, 2020, the Defendants: (a) ice on February 1, 2020, ice B, ice B, and the electorates who actually reside in H were present, and (b) held a ceremony at which the electorates who actually reside in H; and (c) offered K’s secretary M and his spouse N, who wanted to be a candidate for the election of the 21st National Assembly member, which will be held on April 15, 2020, provided K’s job opportunities to take part in the meeting and offer K’s personnel and introduction on behalf of the electorate and offered them free food for free to the participants of the meeting.
Defendant
B proposed that Defendant A and Defendant C have a meeting by gathering local residents from Defendant A and Defendant C on February 2020. Accordingly, Defendant A selected persons to attend the meeting, and on February 9, 2020, around 16:03 on February 9, 2020, Defendant B, Defendant C and those present at the meeting: (a) sent a text message stating “Korea National Assembly member support group” to Defendant B, Defendant C and those present at the meeting: (b) on February 10, 2020: (c) / 30 minutes and time: (d) on February 10, 200: (c) even if an O restaurant (PP station after the PP station); and (d) sent a text message stating “AD”.
